When does iddah start

Fatwaa ID: 2317

AssalamuAlaikum mufti sahab,

When does the three-cycle iddah of divorce start? Does the iddah start at the start of menstruation/bleeding or does it start at the start of the clean period?

In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

In principle, the ‘iddah of a divorcee is three menstrual cycles according to the Hanafi legal school. The ‘iddah starts immediately from the time the talaaq is issued, irrespective of whether she is in her clean days or haydh days, and continues on until she goes through three complete menstrual cycles. As soon as the third menstrual cycle ends, her ‘iddah ends as well. Hence, the total count would vary depending on when the talaaq is issued. A husband is advised to issue talaaq during clean days to prevent from unnecessarily prolonging the ‘iddah.

And Allaah Ta’aala knows best.
