Question:
Salaam Shaykh,
My question is on behalf of someone else.
One lady is working at Wells Fargo Center, as a financial analyst through a contractor. So sometime soon, if she might become a permanent employee of Wells Fargo directly but previously it was a bank. Now it has expanded- bank and financial services. They have to deal with mortgage and all also. So she has this huge doubt if it’s permissible to work there or not, deals with mortgage calculations. It’s all USA based, she doesn’t get Indian holidays also. Office gives holidays for USA festivals and all.
Her process name is prepping i.e. preparing document and invoices of defaulted mortgage houses which comes under wells fargo home lending.
What she does is make a file of all the invoice and documents pertaining to that house ie all utilities bills, maintainence bills, inspection bills, attorney bills, repair and grass cutting bills along with necessary documents, photos and proofs at one place in order and move for claims.
Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
In principle, a woman may work only if there is a need for her to work and there is no one to maintain her adequately. While working, she must observe the laws of hijaab.
The Center in reference provides financial services. It deals with mortgages. The lady in reference has doubts due to being a financial analyst and preparing documents for defaulted mortgages. Her doubts have merit as she is involved in calculating interest and explaining such amounts. Rasulullaah (Sallallaahu ‘alaihi wasallam) said,
دع ما يريبك إلى ما لا يريبك
Translation: “Give up what is doubtful to you for that which is not doubtful”
(Tirmidhi 2518)
We advise against working for the Center.
Sayyiduna Abdullaah ibn Mas’ood (Radhiyallaahu ‘anh) narrates,
لعن رسول الله صلى الله عليه وسلم آكل الربا وموكله وشاهده وكاتبه
Translation: “Rasulullaah (Sallallaahu ‘alaihi wasallam) has cursed the one who consumes interest, the one who pays it, the one who witnesses it and the one who records it.”
(Abu Dawood 3333, Nasaai 5105, Muslim 1598)
And Allaah Ta’aala Knows Best.
