Question:
Assalamualaikum
If a a sahibe nisaab is in debt more than what he posseses should he pay zakaat? And is qurbani wajib upon him?
Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
If a person’s debts encompass his wealth, i.e., he is not left with nisaab after deducting debts, then zakaah and qurbaani are not binding upon him. It should be noted that only that amount which payable within the next twelve lunar months from a long term debt is deductible. Zakaah liability is determined on one’s zakaah date. Qurbaani liability is determined in the days of Qurbaani.
