Zakaah is fardh but husband is stopping me

Question:
Assalamualykum mufti saab.A lady says she has gold and zakat is farz on her but her husband is not allowing her to sell the gold to pay off her zakat. Can she sell without his permission and fulfill her zakat.

Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

There is no obedience to anyone, including the husband, while disobeying Allaah Ta’aala. If zakaah is fardh on a person and the only zakaatable wealth they have to pay their zakaah with is gold, then it will be necessary to sell some gold and pay the zakaah. Alternatively, one may also pay zakaah in kind.

The husband has no right to stop her from fulfilling her obligations. If he tries to do so, then he will be sinful. Furthermore, it is not necessary for her to ask his permission to sell her gold. If the husband wants, then he may pay his wife’s zakaah.
