Question:
I have a query pertaining to Zakaat, regarding jewelry received from a deceased estate please.
My mum passed away on 13th Zul Qada 1444, I received the jewelry on the 15th Zul Qada.
Is the Zakaat amount payable for the entire year ?
Jazakallahu Khairan.
Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
May Allaah Ta’aala elevate your mother’s status in Jannah and grant the family sabr jameel.
In principle, any zakaatable wealth one owns and possesses on his zakaah date will be subject to zakaah irrespective of how long he owned or possessed it. It is not necessary to own every single asset for an entire year. Thus, if something came into one’s ownership even a day before his zakaah date, then that will be subject to zakaah. On the same note, if he had something for almost a year but used it or gave it away the day before his zakaah date, then there is no zakaah on that.
In the enquired situation, you have not stated when your zakaah date is. If you received the gold/silver jewelry before your zakaah date, then you will include it in your zakaah calculation. If you received it afterwards, then there is no zakaah on it for this year.
And Allaah Ta’aala knows best.
