Question:
Assalamu Walaykum.
Question
Is Zakaat payable on inheritance money that has not been received? For example Land abroad has been sold but the buyer has not paid in full yet? 75% of Money has been paid but money is still with a relative and currently no fixed date of being transferred here yet. Would Zakaat be payable on this? Jzk
Answer:
In the Name of Allaah, the Most Gracious, the Most Merciful.
As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.
In principle, there is no zakaah on inheritance that you have not yet received. However, if someone assumes possession of it on your behalf, then that would be regarded as you having received it and thus subject to zakaah.
In the enquired situation, it is not clear who this relative is and what his exact function is in this situation. If he is someone other than estate executor and he has assumed possession of your portion of the proceeds and is simply waiting to transfer it over to you, then that amount will be subject to zakaah.
And Allaah Ta’aala knows best.
